Insolvency & Personal Bankruptcy

The commercial team offer advice on a wide range of aspects of insolvency and Murria Solicitors can advise both individuals and companies on the implications of becoming insolvent.

Personal Bankruptcy

We offer practical and sympathetic advice of how best to deal with your creditors. We can advise on voluntary arrangements pursuant to the Insolvency Act 1986, and the reforms of Enterprise Act 2002 and its effects on personal bankruptcy after 1 st April 2004. Cases are now considered subjectively which result in the automatic discharge of most bankrupts within only 12 months.

Companies

We are able to offer prompt and helpful advice on administrations, Liquidations and receiverships. We can advise you regarding Directors disqualifications the duties and liabilities and worrying aspects such as wrongful trading, or fraudulent trading. The Insolvency Act 2000 amended the Company Directors Disqualification Act 1986 and simplified matters with the DTI with proceedings in the high proportion of cases being concluded with an undertaking rather than a court order, and as a consequence reducing time and costs.
