Victory over ‘bullying’ insurers

We were recently successful in challenging an insurance company’s decision to refuse to pay out on a claim. Following a fire at our client’s home, causing damage estimated to be over £100,000, the household insurance company refused to pay, arguing that our client’s son had criminal convictions, which she did not disclose to them. Our client argued that she did not know that he had any convictions. The insurers stood firm on their decision and we lodged a complaint to the Financial Ombudsman Service, which offers a free service in these sort of disputes. The insurers stepped down and agreed to pay out. The case was handled by one of our Partners, Mr Kang. He said afterwards, “This was a classic case whereby the insurance company picked a technical point to reject the entire claim and tried to save itself over £100,000. This was a ‘David and Goliath’ type case where our client was up against the might of a big insurance company. She decided to take them on and got her just rewards”.
